Terms of Service
1. Agreement
These Terms of Service (“Terms”) are a binding agreement between D20Web LLC, doing business as Power TC (“Power TC,” “we,” “us”), and the business subscribing to or using the Power TC service (“you,” “your office”). By subscribing, creating an office, or using the Service, you accept these Terms.
2. The Service
Power TC is transaction-coordination workflow software for real estate offices: transaction records, date-driven task checklists, agent management, and related tooling. An “office” is a tenant account administered by your designated admin user, who is responsible for managing your office’s users and their access.
3. Subscription and Billing
- Pricing is a flat monthly fee per office (currently $49/month) with unlimited users, billed monthly in advance through Stripe.
- The subscription is month-to-month. You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
- If payment fails and is not cured, or the subscription is canceled, your office may be suspended: sign-in is blocked, but your office’s data is preserved. Access is restored when the subscription becomes active again.
- We may change pricing with at least 30 days’ notice, effective at your next billing period.
4. Your Data
Your office owns the business data it enters into the Service. You grant us a limited license to host and process that data solely to provide, maintain, secure, and improve the Service. You can request an export or deletion of your office’s data at any time. Our handling of personal information is described in the Privacy Policy.
5. Acceptable Use
You agree not to:
- Use the Service unlawfully or to store unlawful content;
- Attempt to access another office’s data or circumvent authentication, isolation, or rate limits;
- Resell, sublicense, or provide the Service to third parties outside your office;
- Interfere with the integrity or performance of the Service.
6. Not Professional Advice
Power TC is a workflow tool. It is not a real estate broker, transaction coordinator of record, attorney, or compliance service, and nothing in the Service is legal, brokerage, tax, or compliance advice. Task templates and dates are aids, not authority — your office remains solely responsible for its transactions, deadlines, disclosures, and regulatory obligations.
7. Demo Sandboxes
Demo offices are provided as-is for evaluation, contain fictional data, and are deleted automatically on a nightly sweep. Do not put real client data in a demo sandbox; anything entered there may be removed at any time without notice.
8. Intellectual Property
We own the Service, its software, and its branding. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your office’s internal business while your subscription is active.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOUR OFFICE PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or unlawful use. Sections 4, 6, and 8–13 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Venue for any dispute is the state or federal courts located in Travis County, Texas.
13. Changes to These Terms
We may update these Terms by posting a revised version with a new “Last updated” date. Material changes will be reasonably notified (for example, by email to office admins). Continued use after the effective date constitutes acceptance.
